Chapter 13 Bankruptcy allows the consumer who has regular income to have the United States Bankruptcy Court to approve a three to five year plan which allows certain past due debts to be paid off over a period of time and other debts to be satisfied by only paying a portion of the total amount owed. This option should be chosen by a consumer who has fallen behind on mortgage or car loan payments and needs a substantial amount of time to repay the past due portion of these debts to the creditor. Chapter 13 is also chosen by those consumers whose incomes are too high to allow a Chapter 7 filing and need to pay off a portion of his/her debts over a period of time and then have those debts discharged.
